By purchasing any product (Software) from Magenest Store you agree to the following (Agreement):
By purchasing the Software you acknowledge that you have read this Agreement and that you agree to the content of the Agreement and its terms, and agree to use the Software in compliance with this Agreement.
The Agreement goes into force at the moment you order our Software from our site or receive it through email or on data medium at the discretion.
We are the copyright holder of the Software. The Software or a portion of it is a copyrightable matter and is liable to protection by the law. Any activity that infringes the terms of this Agreement violates copyright law and will be prosecuted according to the current law. We reserve the right to revoke the license of any user who is holding an invalid license.
This Agreement gives you the right to use only one copy of the Software on one Magento or Woocommerce installation solely for your own personal or business use, subject to all other terms of this Agreement. A separate License should be purchased for each new Software installation (for one domain). Any distribution of the Software without our consent, including noncommercial distribution, is regarded as a violation of this Agreement and entails liability, according to the current law.
You may not use any part of the code in whole or part in any other software or product or website.
You may not give, sell, distribute, sub-license, rent, lease or lend any portion of the Software or Documentation to anyone. You may not place the Software on a server so that it is accessible via a public network such as the Internet for distribution purposes.
You are bound to preserve the copyright information intact, this includes the text/link at the bottom.
We reserve the right to track the domain with our product installed and publish a selected list of users of our Software.
We will not be liable to you for any damages (including any loss of profits/saving, or incidental or consequential) caused to you, your information and your business arising out of the use or inability to use this Software.
We are not liable for prosecution arising from the use of the Software against law or for any illegal uses.
If you fail to use the Software in accordance with the terms and conditions of this License Agreement, it constitutes a breach of the agreement, and your license to use the program is revoked.
License agreement remains effective until terminated. We retain the right to terminate your license to use the Software at any time, if, in its sole discretion, you are not abiding by the terms of the Agreement, including, but not limited to, obscuring or removing any link or copyright notice as specified in this agreement. You may terminate it at any time by destroying all copies of the Software. Termination of this Agreement does not bind us to return you the amount spent for purchase of the Software.
If you continue to use the Software after Magenest JSC gives you notice of termination of your license, you hereby agree to accept an injunction to enjoin you from its further use and to pay all costs (including but not limited to reasonable attorney fees) to enforce our revocation of your license and any damages suffered by us because of your misuse of the Software.
This software is designed to work with a specific Magento or Woocoomerce edition and cannot be used on an edition other than specified. Magenest does NOT guarantee the correct work of the software on any other Magento or Woocommerce edition except the one specified during the purchase process. Magenest does not provide Software support in case of incorrect edition usage.
We provide our customers with free upgrades of the product they buy, limited to the product version branch. It means, buying a product version N.x gives right to receive free updates for the version brunch N. (N.x, N.x.x). After an update is available, all buyers can download it from "Downloadable products" area when logged in. Besides, an email notification is sent stating new version availability. Software upgrades download is also limited by support period defined by customers during the purchase.
E-mail address must be valid because it will be used for communication purposes. It is strongly recommended to use the e-mail address associated with your company. Free emails can be used for registration and checkout process, but orders placed using free email service addresses will be checked more thoroughly and may take longer for activation as a result.
All products are available for download since the payment has been accepted and verified. If you can't download a product please check the status of your payment via a payment processor interface.
All our products are licensed under the OSL License. You have the right to use each purchased theme on one domain only.
We offer free lifetime updates for all of our paid products and a 6-month period of free support from the time of purchase. All support requests are processed on our Jira system and will be responded within 2 business days. Live support requests will only be handled during our business hours, 8 AM to 5 PM from Monday to Friday (GMT+7).
In case customers' support period expires, we have the right to refuse to provide support. Customers can extend their support by purchasing the extended support package.
Support includes answering questions related to our products, bug/error fixing to make sure our products work well on your site exactly like our demo.
Support DOES NOT include other services as customizing our product to fit your own needs, installation service, uninstallation service or conflict with other modules/themes. We ONLY support you with the default features of the module.
Please kindly understand that the tickets arriving at our weekend will be processed when we’re back at the office the next Monday (GMT+7).
Our base support and/or extended support, if stated, is NOT APPLICABLE to certain promotions (E.g: The support-free promotion with the coupon code 'DEVELOPERS') and we retain the rights to refuse support. Trying to purchase a paid extended support package and/or installation service within such promotion range will be counted as a policy violation and is not refundable and disputable.
We refuse to provide support to refunded extensions in our store.
We offer a 30-day money back guarantee for ALL Magento products listed on Magenest store. You can get the refund only in case our extensions fail to function properly due to a bug that we cannot support. Refunds will not be granted if you simply decide not to use the product, use the wrong version or if the product was purchased for evaluation purposes. If you only wish to try it out for evaluation, please access our Demo Site to test the extension. Note that refund will not be granted in case customers ask for the feature that is not our default feature.
Our refund policy also does not cover products that we offer without a support service, either originally or under special promotions. Refunds will not be granted in case of coding conflicts that are related to any other extensions that are installed on your site. If the request for refund is received after 30 days (follow the Paypal invoice date, GMT-6), it will be rejected.
We will require access to FTP credentials and full access right to our extensions in your site's back-end to support you. We will give you a refund if the Software has bugs that we can't fix.
To request a refund, customers must first remove all copies of our software from any either active or inactive store, server, computer, email, etc. and confirm such removal via email firstname.lastname@example.org. Magenest refund policy does not cover installation and customization services, support period renewal fees and in-store reward points. To submit a refund ticket, please navigate to our refund portal.
Our product package does not include any installation service. If you need help to install any product, please contact us for technical support or purchase the installation package in here.
